Limited Warranty and Disclaimer
EnforceGate vX includes a limited warranty and requires valid licensing for operation and technical support eligibility. The support section of the documentation provides further details on technical support plans.
1 Limited Software Warranty
Exosys Sàrl guarantees that for ninety (90) days from initial delivery, the Licensed Software will perform substantially according to documentation when properly installed on recommended virtualized environments and hardware.
2 Exclusive Remedy
If the Software fails to conform during the warranty period, the Licensee's exclusive remedy includes:
- (a) repair or replacement of the Licensed Software, or
- (b) if repair is not feasible, a refund of license fees depreciated straight-line over five years, with license termination.
3 Exclusions from Warranty
The warranty does not cover non-conformance caused by:
- Use on unapproved hardware, hypervisor, or cloud platform;
- Modification by anyone other than Exosys Sàrl;
- Accident, misuse, negligence, or operation outside documentation guidelines;
- Integration with unapproved third-party products;
- Failure to apply provided updates;
- Force majeure or uncontrollable events.
4 Virtualized Environment Performance
Licensees acknowledge that performance in virtualized and cloud environments may be affected by hypervisor resources, network latency, and provider configuration. Exosys Sàrl does not warrant specific performance metrics unless separately guaranteed in writing.
5 Disclaimer
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT OTHER WARRANTIES. EXOSYS SÀRL DISCLAIMS ALL OTHER WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT SHALL EXOSYS SÀRL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE.
